Foggy Privacy Policy Effective Date: March 1, 2026

This Privacy Policy ("Policy") describes how we collect, use, and share your personal information, and explains the privacy rights and choices available to you.

Scope

This Policy applies to Foggy's platform, including the related mobile applications, websites, software, and services (collectively, "Services"). Please also read our Terms of Service ("Terms"), which govern your use of the Services.

As used in this Policy, "Nyfik," "Foggy," "us," "our," and "we" refer to Nyfik, Inc. and the Foggy app. Nyfik acts as a data controller — meaning we determine how your personal information is collected and processed.

If you're located in the United States, please also refer to our Notice for Individuals Residing in Certain US States below.

Information We Collect

You can use Foggy without sharing any personal information with us. If you do choose to share information, here's what we may collect:

Information You Provide

Account Information: Your name, email address, phone number, date of birth, gender, username, and password.

Profile Information: Details you add to your profile, such as a photo or preferred and saved locations.

Support Information: Information you provide when you contact us for help.

Location Information: If you enable location sharing in your device settings or through the app, we collect your location when you use the Services. Our core features don't require precise location access, but some functionality may be limited without it. You can turn off location sharing at any time in your device settings.

Information From Using the Services

Content You Share: Fog reports, saved locations, and in-app feedback you submit.

Usage Information: Actions you take in the app, such as creating an account, logging in, or viewing specific locations.

Device Information: Technical details from the browser, computer, or mobile device you use to access the Services — including device and network information, log files, and analytics data.

Cookies and Tracking Technologies: We use cookies and similar technologies to support the Services. See the Cookies and Similar Tracking Technologies section below for more detail.

Information From Other Sources

Third-Party Accounts: If you sign up or log in using Google or Apple, we receive information like your name, email address, and profile details. To manage what we receive, use the privacy controls in your third-party account.

Service Providers: We may receive information through our service providers, such as when you respond to a survey.

Other Users: Other Foggy users may provide information about you, such as when they view or interact with your fog reports.

How We Use Your Information

We are committed to protecting your personal information. We do not sell your personal data to third parties, and we only share it with service providers as necessary to operate the Services. We use appropriate technical and organizational measures to protect your information from unauthorized access, loss, or misuse.

To Provide the Services

Account Management: We process your account and profile information to create and maintain your account.

Fog Reports and Feedback: We process your fog reports and other content you submit to power the Services.

Map and Location Features: We use your location information to enable map-based features, such as displaying fog at your saved locations.

Personalization: We use information to personalize your experience — for example, suggesting landmarks or locations based on your preferences.

AI Features: We use machine learning (ML) and artificial intelligence (AI) to improve the Services. This includes classifying fog and cloud conditions in the map view, detecting anomalies in fog reports, and — depending on your privacy settings — providing location-based recommendations.

Community Insights: Your fog reports may be used to generate fog status and other community-powered features. We may also share aggregated or de-identified information, such as usage statistics or demographics, with third-party tools we use.

Service Communications: We may contact you about material changes to our Terms, to investigate alleged violations, or to provide customer support.

To Assist You with a Request

We use information to respond to your support requests and comments. Depending on the request, this may include accessing your account to troubleshoot or replicate a reported issue.

To Analyze and Improve Our Services

Analytics: We measure traffic, usage trends, and how people interact with the Services in order to make improvements. This may involve cookies and other tracking technologies.

Service Improvement: We conduct research and use information to analyze, develop, troubleshoot, and improve the Services.

AI Development: We use information — aggregated and de-identified where possible — to train and improve our AI and ML models. Learn more about your choices around contributing to AI development.

To Provide Marketing and Advertising

Marketing: We may send you content about our Services.

Targeted Advertising: We advertise through third parties and may use cookies and tracking technologies to serve relevant ads about our Services. See the Cookies and Similar Tracking Technologies section for more.

To Keep You and the Services Safe

We use automated tools, device information, log files, and other data to protect users and enforce our Terms, Acceptable Use Policy, and Community Standards. This includes detecting misuse, identifying bad actors, and removing content that violates our Terms (such as hate speech or spam). We may review accounts and user activity to ensure compliance, and we may suspend or terminate accounts as a result. We may also process your information when we believe it is necessary to prevent serious harm.

We use age information to help confirm users are old enough to use Foggy and to provide an age-appropriate experience.

For Public Interest Research

We may process information for research aimed at improving public safety, health, or wellbeing.

To Manage Legal and Regulatory Obligations

We may use information to manage or respond to legal obligations, government demands, or regulatory requirements.

How We Share Your Information

Information Visible to Others

Certain information — including your profile and fog reports — may be visible to other Foggy users and the public. For users 18 and older, this is set to "Everyone" by default, which includes non-registered users and search engine results.

Depending on your privacy controls, information like your username, photos, fog reports, and precise location may be viewable on Foggy or to people who are not logged in.

Service Providers

We share information with third parties who help us operate, improve, promote, and secure the Services — or who process payments or fulfill orders. These providers only receive the information necessary for their specific function, and we require them to protect your data.

Third-Party Services

If you use a third-party account (like Google or Apple) to log in, we only share what's needed for login and security. You can also share fog reports via text, email, or social media. Activities you share to other platforms may be visible there, including location information.

Partners

We may share information with partners — such as event sponsors or organizers — when you agree or ask us to. We may also share information with marketing partners or advertising networks to promote our Services (with your consent where required), including through cookies and similar technologies. You can opt out of sharing for targeted advertising via the "Do Not Share My Personal Information" link on our website, or through "Personal Information Sharing" in your app settings.

We do not share text messaging opt-in data or consent with third parties.

Business Transfers

If Nyfik or Foggy is involved in a merger, acquisition, bankruptcy, reorganization, or similar transaction, your information may be shared or transferred as part of that process.

Legal Requirements and Prevention of Harm

We may share your information with law enforcement, government agencies, or other third parties when required by law or legal process — including in response to court orders, warrants, or subpoenas.

We may also retain or disclose your information when we reasonably believe it's necessary to: (1) prevent death, serious injury, or significant harm; (2) address national security or public interest concerns; (3) prevent or detect violations of our Terms or fraud; or (4) protect our operations, property, or legal rights.

Cookies and Similar Tracking Technologies

We use cookies, tracking pixels, SDKs, Google Analytics, and other third-party tracking technologies for security and authentication, to improve your experience, for analytics, and to inform and serve relevant ads. Your Privacy Rights and Choices

We provide a range of privacy controls so you can manage your information in ways that match your preferences. The rights available to you may vary depending on where you live and may be subject to certain exceptions.

Access and Portability: You may request access to the personal information we collect, use, or share about you. Much of this is available by logging into your account. To download your data, follow the instructions in the app to export.

Correct Your Information: You may correct inaccurate information at any time through your account settings.

Restrict or Delete: You may request that we restrict or delete your personal information. You can delete content like fog reports and saved locations, or delete your account entirely through your settings. Once deleted, we cannot restore your data. It may take up to 45 days to fully remove your information from our systems.

Revoke Consent: Where we rely on your consent to process information, you may withdraw it at any time through your settings. Withdrawal doesn't affect processing that occurred before you withdrew consent.

Automated Decision-Making: We sometimes use AI and automated tools to analyze your information, as described above. We do not use these technologies for decisions that have legal or similarly significant effects on you.

Note: We don't have control over content you've shared directly on other platforms, or that others may have copied. Fog reports may remain briefly visible after deletion. Search engine caches may also display your information until they refresh.

Children's Privacy

Foggy is not intended for, nor directed to, children under 13. We do not knowingly collect personal information from anyone under 13. If you are under 13, do not use the Services.

We provide additional privacy and safety protections for users under 18. For more information, see our minor-specific privacy guidance.

How We Protect Your Information

We maintain administrative, technical, and physical safeguards consistent with appropriate industry standards to protect your information from unauthorized use, disclosure, or access.

Retention of Information

We retain your information for as long as needed to provide the Services, subject to our legal obligations. We generally keep information associated with your account until you delete it or we no longer need it. In making these decisions, we consider the nature and sensitivity of the data, the purposes for which we process it, and applicable legal requirements.

We will cease processing unless we have compelling legitimate grounds or legal obligations to continue. You may also object to direct marketing by turning off email newsletters in your settings. You may have the right to lodge a complaint with your local data protection supervisory authority.

Legal Bases for Processing

Certain data protection laws require us to identify a legal basis before processing your personal information. The bases we rely on include:

Contract: Processing necessary to perform our agreement with you or to take steps at your request before entering into one.

Consent: When you've given us permission for a specific purpose. You can withdraw consent at any time.

Legitimate Interests: When we use your information in ways that are reasonably expected and don't unfairly affect your rights.

Legal Obligation: When we're required by law to process your information.

Vital Interests: When processing is needed to protect someone's life or safety.

Cross-Border Data Transfers

If you're located outside the United States and use the Services, your information will be transferred to, processed, and stored in the United States. When we transfer personal information internationally, we use legal mechanisms — such as Standard Contractual Clauses — to ensure appropriate protection. Contact us if you'd like more information or copies of the applicable safeguards.

Notice for Individuals Residing in Certain US States

Residents of California, Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, Virginia, and other states with similar privacy laws may have additional rights under applicable state law.

Opt Out of Targeted Advertising: You can opt out of sharing your personal information for targeted advertising via the "Do Not Share My Personal Information" link in the website footer, or through "Personal Information Sharing" in your Privacy Controls in the app. You may also use an Opt-Out Preference Signal, such as the Global Privacy Control. Note: we do not currently process Do Not Track (DNT) signals.

Sensitive Personal Information: We do not use or disclose sensitive personal information for purposes beyond providing the Services, with your consent, or as otherwise permitted by law.

Non-Discrimination: We will not discriminate against you for exercising any of your state privacy rights.

Appeals: You may have the right to appeal our response to a privacy request.

Authorized Agents: You may appoint an authorized agent to act on your behalf. We may ask for proof of authorization and may also verify your identity directly.

Privacy Policy Updates

We may update this Policy from time to time. When we do, we'll post the revised version with its effective date on our website. For material changes, we'll provide prominent advance notice. If you object to any updates, you should stop using the Services and delete your account.
