Foggy Privacy Policy 2026
Effective Date: June 22, 2026This Privacy Policy (“Policy”) describes how we collect, share, and use your personal information, as well as how to exercise your privacy rights and choices :
Scope
This Policy applies to Foggy’s platform, including the related mobile applications (app), products, websites, technology, software, and services (collectively, “Services”). Please also read our Terms of Service (“Terms”), which set out the terms governing the Services. As used in this Policy, the words “Nyfik,” “Foggy”, “us,” “our,” or “we” means Nyfik, Inc. and Foggy, the app providing the Services to you. Under this Policy, Nyfik acts as a data controller or “business” for the personal information we process. This means we decide how to collect and process personal information.
For individuals in the United States, please also refer to our Notice For Individuals Residing In Certain US States below.
Children’s Privacy
The Services are for a general audience and are not specifically directed at or designed for children under the age of 13. We do not knowingly collect personal information from individuals under 13. If you become aware that your child has provided us with personal information without your consent, please contact us using the details in the Contact Us section below. For all users, including users under 18 in California and other jurisdictions, we apply a "privacy by default" standard and offer the highest privacy settings unless the user or parent explicitly adjusts them.
Information We Collect
Information You Provide
You can use Foggy without sharing any information about you with us. If you decide to share it with us, the types of information we collect are as follows.
No User Account: We do not have user accounts so there is no account to create, update or delete.
Contact Information: if you choose to receive our newsletter, we collect your email address.
Install ID and Device-ID: When you install Foggy on your device, your device generates a unique Install ID (which can be found in the app under Menu>Settings) which we store in PostHog, the third-party analytics platform we use to link events generated by your use of Foggy. An anonymized version of this Install ID called your Device ID is stored in a separate application database. Your information, such as your fog reports, are associated with your Device ID and stored in databases that are separate from the one storing your Install ID.
Support Information: information you provide in connection with requests for support such as your email address or Install ID found in the app under Menu>Settings.
Location Information: Our Services do not require you to share your location or grant us permission through your device to track your device’s precise location, however some functionality will be limited if you do not. If you share your location in your device settings or by accepting sharing your location through Foggy, you have the option to share precise or approximate location. In this case, we collect location information only while using Foggy. We store location information associated with fog reports at the tile level to be able to show fog reports by neighborhood (or aggregated tile level if imprecise location has been granted). You can stop sharing location at any time within your device settings and still use the Services, though some functionality will then be limited.
Information From Using the Services
Content You Share: We collect content you share through the Services, such as fog reports, and in-app feedback.
Usage Information: We collect information from your use of the Services, including actions you take such as opening the app, logging a community fog report or repositioning the map view.
Device Information: We collect technical information from the browser, computer, or mobile device used to access the Services. This includes device and network information, log files, and analytics information.
Analytics and Third-Party Technologies: We collect and use information for analytics purposes to improve our Services. We do this through third-party technologies like Posthog that remove IP addresses and anonymize Device IDs.
Information From Other Sources
Service Providers: We may collect information through our service providers, such as when collecting feedback through surveys.
Third-Party Purchase Platforms: When you pay to download Foggy through a platform like the Apple App Store or Google Play, they provide us with a transaction identifier linked to your device ID, but they do not provide us with your full payment details.
How We Use Your Information
We are committed to protecting your personal information. We do not sell your personal data to third parties, and we only share it with service providers as necessary to operate our Services and fulfill services you have requested. Your information is kept safe and we employ robust technical measures to protect it from unauthorized access, loss, or misuse.
To Provide the Services
Record Your Fog Reports and Feedback: We process your Fog Reports, feedback and other information to help you and other users.
Enable Location-Based Features: We use your Location Information to enable certain map-related features, such as logging your fog reports and showing you the community fog report for your location.
Customize Your Experience: We use information to personalize your experience. For example, we may reposition the map view based on your location. We do not store your location information.
Provide AI Features: We use and develop machine learning (“ML”) and artificial intelligence (including large language models) (“AI”) to provide features designed to improve the Services (“AI Features”). AI Features include, for example, classifying fog and cloud status to tell you if it is foggy or cloudy in the area of interest in the map view, and protecting the integrity and security of our Services (such as detecting anomalies in fog reports).
Share Insights: We help users better understand the fog through the information you and others provide. For example, we may share your anonymized fog reports in the experience others see. We may also use your fog reports to generate our fog status and other community-powered features. We may also share aggregated or de-identified information, such as usage or demographics with third-party tools we use.
Contact You About the Services: If you provide your contact information to us, we may contact you about material changes to our Terms, when investigating alleged violations of our Terms, or with customer support messages.
To Assist You with a Request
We use information to provide support in response to your requests and comments. Depending on your request, and if you have provided it, we may use your Install ID (for example, to troubleshoot or replicate a reported issue).
To Analyze and Improve Our Services
Analytics: We use information to measure traffic and usage trends, understand how visitors and users interact with content, and make improvements. This may include the use of cookies and other tracking technologies, as described in the Cookies and Similar Tracking Technologies section.
Services Improvement: We use information to conduct research, and to analyze, develop, troubleshoot, increase functionality, and otherwise improve the Services.
AI Development: We use information to enhance the quality, reliability, and/or accuracy of our AI Features by creating, developing, training, testing, improving, and maintaining AI and ML models run by Nyfik or our service providers. We use aggregated, de-identified information for AI Features and their development.
To Provide You with Product Marketing
Content About Our Services: We use information to send you content about our Services such as content on how to use Foggy and new features we release to enhance the Foggy experience. We do not send you content about services of third parties.
To Protect You, Others, and the Services
We aim to protect users, enforce our Terms of Service, and promote safety. We use automated tools, device information, log files, and other information for these purposes. For example, we seek to detect misuse and bad actors, and to remove content that violates our Terms, such as hate speech or spam. We reserve the right to review profiles and user actions to ensure compliance with our Terms, and we can suspend or terminate access to Services as a result. We may also process your information when we believe it is necessary to prevent serious harm.
To Conduct Public Interest Research
We may process information for research aimed at improving public safety, health, or wellbeing.
To Manage Legal and Regulatory Obligations
We may use information to manage or respond to demands or obligations related to the law, government entities, or other regulatory bodies with respect to the Services.
How We Share Your Information
We may share your information as follows:
Information Visible to Others
Your anonymized fog reports may be visible to other Foggy users and the public.
Affiliates and Subsidiaries
We may share your information with our corporate affiliates and subsidiaries for business purposes, such as internal administration, centralized legal, or technical functions.
Service Providers
We may share your information with third parties to support, improve, promote, and secure the Services; process payments; or fulfill orders. These service providers only have access to the information necessary to perform specified functions on our behalf. We require them to protect and secure your information.
Third-Party Services
You can share your information (including fog reports) via text, email, or on social media applications like Instagram. Activities you share to other social networks may be viewable on those platforms, and may include location information.
Partners
We do not disclose any information about you to third-party marketing partners or advertising networks.
Acquirers of Our Business or Assets
If Foggy or Nyfik become involved in a business combination, acquisition, securities offering, bankruptcy, reorganization, dissolution, or other similar transaction, we may share or transfer your information in connection with such transaction.
Legal Requirements and Prevention of Harm
We may preserve and share your information with third parties, including law enforcement, public or governmental agencies, or private litigants, within or outside your country of residence, if we determine that the law compels or reasonably requires such disclosure. This may include responding to court orders, warrants, subpoenas, or other legal or regulatory process, or disclosures that are otherwise permitted by law.
We may also retain, preserve or disclose your information if we determine it is reasonably necessary or appropriate to: (1) prevent death, serious bodily injury, or other significant harm; (2) address issues of national security or other issues of public importance; (3) prevent or detect violations of our Terms or fraud or abuse of Foggy or its users; or (4) protect our operations or our property or other legal rights, including in connection with actual or potential litigation.
Cookies & Similar Tracking Technologies
We collect, use, and disclose information through the use of cookies and other third-party tracking technologies for security and authentication, to understand and improve your experience, perform analytics, and allow you to use our Services.
Do Not Track and Global Privacy Control Signals: We do not currently respond to web browser 'Do Not Track' signals, and we do not currently respond to Global Privacy Control (GPC) signals.
Your Privacy Rights and Choices
We provide a variety of privacy controls to manage your information. We encourage our users to adjust their controls to align with their desired experience.
Below are privacy rights that may be available to you under applicable laws depending on where you live and subject to potential limitations and exceptions. If you need further assistance exercising your rights, please use the Contact Us information below.
Access and Portability: You can access much of your information within the mobile app in the Menu. To download your data, including your activity files, follow the instructions here to export your data.
Rectify or Correct: You may have the right to correct inaccurate information. You may correct, amend, or update most of your information at any time by adjusting that information in your settings.
Restrict or Delete: You may have the right to restrict or delete your information. You can restrict or delete much of your information through your account, such as deleting content like fog reports. To delete all data associated with your Install ID, email support@foggysf.app. Once deleted, we cannot reinstate your data, including your fog reports. Following deletion of your account, it may take up to 45 days to delete your information and system logs from our systems.
We do not have control over content you have shared directly or publicly with others, such as screenshots from our Services, or that others may have copied from our Services. Your anonymized fog reports may also remain available for a short duration.
Revoke Consent: To the extent we rely on your consent to engage in certain processing, you may have the right to withdraw that consent at any time. You can use your settings to withdraw consent, for example to stop location sharing. Please note that the withdrawal of your consent will not affect processing done previously based on that consent. For example, fog reports will be processed based on the consent provided at that time.
Automated Decision-Making: We sometimes use AI Features and automated decision-making to analyze your information, as described above. However, for any decision of significance, such as a decision to suspend a user, we ensure human oversight and do not rely solely on automated decision-making for significant effects.

How We Protect Information
We implement measures to manage your information securely and consistently with this Policy. We maintain administrative, technical, and physical safeguards in accordance with appropriate industry standards that are designed to protect against unauthorized use, disclosure, or access to personal information.
Retention of Information
We retain information as long as needed to provide the Services, subject to our legal obligations. We generally keep information associated with your Install ID until you delete it or we no longer need the information to provide the Services. In making these determinations, we consider the amount, nature, and sensitivity of the personal information, the purposes for which we process it, whether we can achieve those purposes through other means, and applicable legal requirements.

Below is additional information in accordance with data protection laws in the European Economic Area (“EEA”), the United Kingdom (“UK”), Switzerland, Brazil, and other relevant jurisdictions.

Data Subject Rights: Please see Your Privacy Rights and Choices above for a list of rights we provide to you, as well as how to exercise them. In addition, you have the right to object to, and seek restriction of, our processing of your personal information based on our legitimate interests or the performance of a task carried out in the public interest. In such cases, we will cease processing your information unless we have compelling legitimate grounds to continue processing or where necessary for legal reasons. You may also have the right to complain to your local data protection supervisory authority.
EEA Supervisory Authority: Nyfik’s lead supervisory authority in the EEA is the Danish Data Protection Agency (Datatilsynet).

No Third-Party Targeted Advertising: We do not share your information with third-party marketing partners or advertising networks.
Limit Use of Sensitive Personal Information: We do not use or disclose sensitive personal information for purposes other than with your consent to provide the Services, or as otherwise permitted by law.
Non-Discrimination: We will not discriminate against you for exercising any of your US State Privacy Law rights.
Appeal: You may have the right to appeal our decision regarding a request related to your privacy rights.
Authorized Agents: You may appoint an authorized agent to exercise any of your privacy rights on your behalf. To verify that your authorized agent acts on your behalf, we will ask for proof from your agent and may require that you also verify your identity.
Privacy Policy Updates
Nyfik reserves the right to modify this Policy at any time. If we make changes to this Policy, we will post the revised policy and its effective date on our website. If we make changes we deem to be material, we will provide prominent, advance notice. If you object to any changes to this Policy, you should stop using the Services and delete your account by contacting support@foggysf.app and instructing us to do so.
